Mitchell Chaban is a legal strategist, counselor, and trial lawyer with more than 25 years of experience representing businesses, municipalities, and individuals in business, commercial, employment, and real estate-related matters. Mitchell represents a wide range of clients, including small businesses, mid-sized companies, closely held corporations and limited liability companies (LLC), professional practices, sole proprietorships, and select individuals. Mitchell’s clients cover a variety of industries, including automotive, banking, construction, freight logistics, health care, information technology (IT), manufacturing, financial services, professional services, employee assistance program (EAP) providers, and film and photography, among others.

Mitchell is an experienced courtroom strategist and first-chair trial lawyer, having tried numerous cases to verdict in Illinois and federal courts. Mitchell is adept at obtaining emergency relief, such as a temporary restraining order (“TRO”) and preliminary injunction. Mitchell litigates cases involving breach of contract, breach of fiduciary duty, collections, consumer fraud, conversion, copyright infringement, deceptive business practices, defamation, evictions, fraudulent misrepresentation and concealment, landlord-tenant disputes, mortgage foreclosure, quiet title, misappropriation of trade secrets, trademark infringement, tortious interference, and partnership, shareholder, and membership disputes. Mitchell also frequently represents clients in alternative forms of dispute resolution, including mediations as well as arbitrations in the American Arbitration Association (“AAA”), the Financial Regulatory Authority (“FINRA”), and the International Centre for Dispute Resolution (“ICDR”), among others.

Mitchell primarily represents employers and select individuals in workplace-related litigation, including discrimination, hostile work environment, sexual harassment, retaliatory discharge, whistleblower claims, and wage, commission, and bonus disputes. Mitchell represents clients in Illinois and federal courts as well as before the Equal Employment Opportunity Commission (EEOC), the Illinois Department of Human Rights (IDHR), the Illinois Department of Employment Security (IDES), and the Illinois Department of Labor (IDOL). Mitchell advises business clients on the day-to-day human resources and personnel issues that arise, including employee discipline, paid time off, reasonable accommodations for employees with disabilities, Family and Medical Leave Act issues, overtime, and other wage and hour issues. Mitchell also drafts employee policy manuals and handbooks, confidentiality agreements, employment agreements, non-competes and other restrictive covenants, severance and separation agreements, and other employment documents. Mitchell has experience conducting workplace investigations involving suspected employee misconduct, hostile work environment, sexual harassment, and bullying. Mitchell also has experience advising clients on responding to audits initiated by the IDHR, IDES, and IDOL.
