With over 17 years of experience litigating complex commercial and business disputes, Partner Robert Carroll has refined a systematic approach to litigation premised on precise issue spotting, careful organization, and meticulous preparation. Combined with his well-honed advocacy skills, these qualities allow Rob to effectively and efficiently advance and defend his clients’ interests in matters of all kinds and complexity.


Rob recognizes that when clients come to him, they often do so because they face a problem or conflict that could disrupt their business, create uncertainty, and cause them unneeded stress and frustration. He knows that they rely on him to provide clear communication, honest counsel, and a path forward.  Rob’s starting point in any matter is to take the time needed to fully understand a client’s concerns, perspectives, and objectives. By truly listening to his clients and their stories, Rob can ask the right questions, assess the relevant legal and factual issues, and develop tailored strategies that achieve positive outcomes.

Rob’s diverse litigation experience includes complex commercial and business matters, employment disputes, breach of contract actions, trust and estate litigation, derivative lawsuits, shareholder disputes, partnership disputes, breach of fiduciary duty claims, fraud claims, and professional negligence cases. Among his many successes, Rob served as lead counsel in a derivative suit against a group of controlling general partners who diverted millions of dollars of assets from the limited partnerships in breach of their fiduciary duties. After years of hard-fought litigation, including a month-long intensive trial, he secured an award in excess of $83 million for the partnerships.

His professionalism and talents as a litigator have earned Rob accolades from his peers, including his inclusion on the list of Super Lawyers – Rising Stars Edition for seven consecutive years. Rob earned his law degree from DePaul University College of Law, and when not serving his clients, he likes to spend quality time with his wife and five kids. He also enjoys rock climbing, weightlifting, running, snowboarding, playing chess, and reading.

  • Represented two partnerships in breach of fiduciary duty action against general partners for misappropriating tax increment finance bonds, resulting in an $83 million award for the partnerships.

  • Represented more than 100 investors in fraudulent misrepresentation action involving a failed roll-up transaction, resulting in the investors being awarded $17.5 million.

  • Represented member-manager of an Illinois limited liability company in action to remove the other member-manager under the companies’ operating agreement and the Limited Liability Company Act.

  • Negotiated and documented a complex separation agreement between two partners involving multiple businesses.

  • Defended general partner of a $100 million real estate investment fund in action by limited partners to remove the general partner.

  • Represented investors in a multi-million dollar real estate deal against the developer for engaging in a complex corporate restructuring in order to improperly cut them out of the deal.

  • Defended prominent real estate clients in action brought by former partners for breach of fiduciary duty, breach of contract and an accounting.

  • Defended limited liability company and two of its members in an action by third member for dissociation.

  • Represented employee against former employer for defamation and breach of employment agreement, resulting in a $3 million jury verdict for the employee.

  • Represented business in action against former employee for soliciting clients in breach of his fiduciary duty and restrictive covenant, which resulted in a $400,000 settlement.

  • Defended two executives in $20 million claim by former employer for fraud and breach of fiduciary duty.

  • Represented former executive of a publicly traded company in claims that company breached his employment agreement and that members of the board intentionally interfered with the employment agreement, resulting in a settlement favorable to the executive.

  • Represented employee in action against former employer for violations of the Illinois Wage Payment and Collection Act, resulting in a settlement favorable to the employee.

  • Represented an individual in a breach of fiduciary duty claim against his former attorneys, resulting in a $1 million jury verdict for the client and against the attorneys.

  • Represented tenant in an action against his former attorneys for negligent representation in an eviction proceeding.

  • Represented trust beneficiary against a prominent national law firm for negligently representing him in claim that the trustee breached its duty in management of the trust, resulting in an award in excess of $1 million for the trust beneficiary.

  • Represented potential beneficiaries (family members) of trust agreement in dispute with other potential beneficiaries (charities)

  • Defended prominent real estate developer in claim that it breached a multi-million dollar commercial real estate purchase agreement.

  • Represented high profile real estate client in breach of lease claims.
